Bridal Makeover Contest - Terms & Conditions

• Organizer: “Malabar Gold and Diamonds SDN BHD” hereinafter referred to as the "Organizer."
• Service Providers: Refers to the sponsors, makeup artists, photographers, saree drapists, and other professionals involved in delivering the bridal makeover services.

• Contest Period: The period during which entries for the Contest are accepted.
• Participants: Individuals who meet the eligibility criteria and submit valid entries.
• Prize: Ten (10) winners will receive a complete bridal makeover from the Service Providers, including hair styling, makeup, and saree draping.
• Eligibility:
• The Bridal Makeover Contest ("Contest") is open to individuals who are engaged and planning to marry within the next Twelve (12) months.
• Participants must be residents of Malaysia and meet the legal age requirements as per Malaysian law.
• Employees, affiliates, agents, and immediate family members of the Organizer and Service Providers are not eligible to participate.
• Contest Period:
• The Contest begins on 16th January 2025 and ends on 25th January 2025.
• Entries received after the Contest Period will not be considered.
• How to Enter:
• Participants must submit their entry by completing the designated form by 25th January 2025.
• Each participant is allowed only one entry.
• Entries must include all required information, including contact details and proof of eligibility, failing which the entry will be deemed invalid.
• Winner Selection:
• Winners will be selected from all eligible entries.
• Ten (10) winners will receive a complete bridal makeover from the Service Providers, including hair styling, makeup, and saree draping.
• Prizes are non-transferable and cannot be exchanged for cash or other products/services.
• Winners will be selected by a judging panel, and the judges' or Organizer's decision is final and binding. The judging panel will evaluate based on creativity, uniqueness, and the nature of the participant's submission.
• Winners will be notified by phone by 27th January 2025 and must claim their prize by 28th January 2025.
• Winners will be informed of the date, time, and venue for the makeover session.
• 7.If a winner cannot be contacted after three attempts, a new winner will be selected.
• The Organizer reserves the right to request additional documentation to verify the eligibility of winners, including but not limited to proof of engagement and wedding plans.
• Photo and Video Session Requirement:
• Participants agree to participate in a photo and video session arranged by the Organizer or its representatives upon completing the bridal makeover.
• Participants will follow the guidelines provided by designated photographers/videographers.
• Participation is voluntary and will not receive any compensation, remuneration, or royalties for the appearance or contribution to the promotional materials
• Participants who wish to opt out of the photo and video session must notify the Organizer beforehand in order to make necessary arrangements to exempt them from this requirement.
• The Organizer retains the rights to all photos and videos captured during the session for marketing and promotional purposes.
• Photographs and videos may be used indefinitely or for a duration determined by the Organizer.
• Marketing:
• By participating, participants grant the Organizer and Service Providers permission to use their photos and videos for marketing, branding, and promotional purposes.
• This permission extends to the use of participant-related photos or videos in various promotional materials, including but not limited to print media, social media platforms, and television advertisements. The participant acknowledges and consents that the Organizer and its Service Providers may utilize these materials for promotional purposes without any further consent or compensation.
• The participant also acknowledges that any photos or videos used for marketing or promotional purposes will be related solely to the contest in which they participated and may be displayed in association with the Organizer’s and Service Providers branding or promotional initiatives.
• By participating in the contest, the participant relinquishes any rights, claims, or demands related to the use of their photos or videos by the Organizer and its Service Providers for promotional activities as mentioned above.
• Personal Information:
• Personal information collected will be used solely for administering the Contest and will not be shared with third parties without consent.
• Participants have the right to access and correct their personal data by contacting the Organizer.
• Personal data will be handled in accordance with the applicable data protection laws in Malaysia.
• Organizer’s Rights:
• The Organizer reserves the right to disqualify participants for violating these Terms & Conditions.
• The Organizer is not responsible for loss, damage, or injury resulting from participation or prize use.
• The Organizer reserves the right to modify, suspend, or cancel the Contest due to unforeseen circumstances.
• The Organizer may require documentation to verify a winner’s eligibility.
• The Organizer reserves the right to disqualify participants attempting to undermine the Contest or its integrity.
• The Organizer reserves the right to substitute any prize with an item of equal or greater value.
• The Organizer reserves the right to amend these Terms & Conditions and notify participants of changes.
• In case of dispute, the Organizer’s decision shall be binding.
• The Organizer reserves the right to disqualify and/or seek damages from any individual making any attempts to deliberately damage or undermine the event or this campaign which is a violation of criminal and civil laws to the full extent permitted by law. In such an event, the Organizer shall not be liable to provide any other benefit or any compensation in lieu thereof.
• Governing Law:
• The Contest is governed by the laws of Malaysia, and participants agree to submit to the exclusive jurisdiction of Malaysian courts.
• Agreement to Terms:
• Participation is voluntary and constitutes acceptance of these Terms & Conditions.
• Participants confirm they have read, understood, and agreed to these terms. Participants agree to abide by these official rules and all decisions of the Organizer.
• Any disputes arising from or related to the Contest shall be resolved amicably, failing which the matter shall be escalated to the appropriate legal forum.
• Organizer shall neither be held accountable nor held responsible to the selected participants for bad conduct and misbehavior from the Service providers during the event.
• Disclaimer of Liability:
• Neither Organizer nor any of its respective parent companies, subsidiaries, affiliates and each of their respective officers, directors, shareholders, agents and employees shall be responsible for incorrect or inaccurate entry of information, human error, technical malfunction, lost/delayed data transmission, lost/delayed/misdirected mail, omission, interruption, deletion, defect, line failure of any telephone or other network, computer equipment, software or any combination thereof, or for late, lost, damaged, misdirected, incorrect data/bill/entry.
• Organizer and its group companies, affiliates and marketing agencies will not be liable to any participant or winners or user of the event pass/guest for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this campaign or the acceptance or use of the winning i.e. Bridal Makeover.
• Organizer shall not be responsible for system outages, delays, equipment malfunctions, errors, or data loss of any kind, lost or unavailable connections, or failed, incomplete, garbled, or deleted transmissions or other technological difficulties or any other force majeure event that may prevent a participant from participating in this Contest or receiving the winner information or obtain the winning i.e. Bridal Makeup from the Organizer within time or attend the Event. Further, Organizer shall not be held responsible or liable for
• any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control.
• any late, lost, misrouted, or damaged transmissions.
• any computer or communications-related malfunctions or failures.
• any disruptions, losses or damages caused by events beyond the control of the Organizer; or
• any delay, non-receipt or lost event pass
• any loss or damage caused to the user of the event Pass.
• in case the contest is called-off or abandoned or shifted out of the scheduled Venue.
• I, the undersigned participant, hereby confirm and declare that I have carefully read, comprehended, and unequivocally agreed to abide by the Terms and Conditions outlined hereinabove regarding my participation in the Free Bridal Makeover Contest organized by Malabar Gold & Diamonds. I explicitly acknowledge the following:
• I have thoroughly reviewed and understood all clauses, rules, and regulations stipulated in the provided Terms and Conditions governing my involvement in the aforementioned contest.
• I am aware and consent to the rights, responsibilities, and obligations outlined for participants, including but not limited to entry requirements, eligibility criteria, contest duration, judging criteria, and prize distribution.
• I understand and accept the conditions related to the collection, processing, and utilization of any personal information or data I provide during the contest, as specified in the privacy policy.
• I acknowledge and agree that any content generated by me during the contest, including photos, videos, or written submissions, may be used by the Organizer and its Service Providers for marketing, advertising, and promotional purposes, as detailed in the relevant clauses of the Terms and Conditions.
• I comprehend and accept the limitations of liability, disclaimers, and indemnification clauses as stated in the Terms and Conditions, acknowledging that the Organizer and its affiliates are not accountable for any potential loss, injury, or damage incurred during my participation in the contest.
• I confirm that my participation in the contest is voluntary and that I am not under any coercion, misrepresentation, or duress to agree to these Terms and Conditions.
• I hereby declare that I am of legal age and possess the necessary capacity and authority to enter into this agreement without any constraints or legal impediments.
• I affix my signature below as an affirmation of my understanding, acceptance, and agreement to be bound by the Terms and Conditions governing the above stated contest.
